Detention and Interview of a Suspected Shoplifter: Don't Make a Bad Situation Worse

In addition to the obvious impact of shoplifting on loss control, retail theft presents a more significant hidden risk to merchants. In their zeal to control the costs associated with retail theft, merchants may unwittingly become exposed to the much greater costs of civil litigation. If the detention and interview of a suspect is done improperly, the merchant may face allegations of false imprisonment, battery, or malicious prosecution. Fortunately, the Retail Theft Act provides an important opportunity for protection.
This program involves the participation of both a Loss Control Specialist and an attorney that specializes in unlawful detention cases. The presenters will share past experiences and offer specific examples of proper case handling. They will explain the real costs associated with the improper detention of theft suspects. Program materials will include practical guidance for the creation and implementation of a Loss Control Plan for use by PFMA members.

An overview of two certification programs — LPCQualified, a program for novice loss
prevention employees, and LPCertified which is offered for more experienced LP
personnel. The Loss Prevention Foundation is a not-for-profit organization created to oversee the educational certification programs, which are endorsed by the Retail Industry Leaders Association (RILA), the Food Marketing Institute (FMI) and the National Food Service Security Council (NFSSC).
